2. Eligibility

Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. If you are a minor (under the age of 18 years), you may use the Website only with the involvement of a parent or guardian.

3. Intellectual Property Rights

Trademark Notice: The "TOMPOM" brand name and logo are the exclusive property of Samarebhe Enterprise. A trademark application has been filed with the Trade Marks Registry, India, and is currently under final clearance. Any unauthorized use, reproduction, or modification of the brand name or logo is strictly prohibited.
Copyright: All content including slogans (e.g., "REBEL. REVOLT. REDEFINE."), images, website design, and text are protected by the Copyright Act, 1957.

4. Pricing and Payments

Taxation: All prices are listed in Indian Rupees (INR) and are inclusive of GST at the applicable rates.
Changes: Prices for our products are subject to change without notice.
Payment Security: Payments are processed through secure third-party gateways. We do not store your credit card or UPI PIN details.

5. Mandatory Product Declarations

In compliance with the Consumer Protection (E-Commerce) Rules, 2020:

Country of Origin: All products are "Made in India."
Marketed By: Samarebhe Enterprise, Kolkata.
HSN Code: Apparel items follow the HSN 6109 classification.

6. Order Cancellation and Shipping

Cancellation: We reserve the right to cancel any order due to stock unavailability or pricing errors. In such cases, a 100% refund will be issued.
Shipping: Delivery timelines are estimates provided by third-party courier partners. Samarebhe Enterprise is not liable for delays caused by logistics partners or "Acts of God."

7. Limitation of Liability

In no event shall Samarebhe Enterprise be liable for any indirect, incidental, or consequential damages arising out of the use of our products. Our maximum liability to you is limited to the amount paid for the specific product in question.

8. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.

9. Grievance Redressal Mechanism

In accordance with the Information Technology Act, 2000 and the Consumer Protection (E-commerce) Rules, 2020, the name and contact details of the Grievance Officer are provided below:

Shipping & Returns Policy

1. Shipping Information

At TOMPOM, we aim to get your "unapologetic" gear to you as fast as possible.

Processing Time: All orders are processed within 1-2 business days. Orders are not shipped on Sundays or Public Holidays.
Delivery Timelines:
- Metro Cities: 3-5 business days.
- Rest of India: 5-7 business days.
Shipping Charges: We offer Free Shipping on all prepaid orders above ₹999. For orders below this, a flat shipping fee of ₹49 applies.
Tracking: Once your order is dispatched, you will receive a tracking link via email and/or WhatsApp.

2. Returns & Exchange Policy

We want you to love your TOMPOM pieces. If something isn’t right, we’re here to help.

Return Window: You can request a return or exchange within 4 days of delivery.
Conditions for Return:
- The item must be unworn, unwashed, and in the same condition that you received it.
- All original tags and packaging must be intact.
Non-Returnable Items: For hygiene reasons, certain items like innerwear or items bought during a "Final Clearance Sale" may not be eligible for return.

3. How to Initiate a Return/Exchange

Send an email to listen@tompom.co.in or message us on WhatsApp with your Order ID and a photo of the product.
Our team will approve the request within 24-48 hours.
Reverse Pickup: We will arrange a reverse pickup from your address at no extra cost (subject to location availability).

4. Refunds

Prepaid Orders: The refund will be processed back to your original payment method (Bank Account/UPI/Card) within 5-7 business days after the product reaches our warehouse and passes quality check.
COD Orders: For Cash on Delivery orders, we will provide a Store Credit/Gift Card or a refund via UPI/Bank Transfer once you provide your details.

5. Damaged or Wrong Products

If you receive a damaged product or the wrong size/design, please notify us within 24 hours of delivery with an unboxing video (recommended). We will replace it immediately at no extra cost.
